Scope

These terms govern use of the Winart application operated by Winart Limited. They cover accounts, content, voice rooms, live streaming, messages, gifts, Diamonds, Creator Coin, agencies, VIP, and virtual items that the application actually implements. The published terms page is https://winart.win/terms-of-service/. This in-app text is the application copy. It covers chat, voice, live video, gifts, Diamonds, and VIP. It does not cover match-play features or chain-based payments.

By accepting this version you enter these terms. Privacy acknowledgement is a separate record. An age declaration is a separate record. Marketing consent is not included.

Definitions

Eligibility and registration

You must submit a separate declaration that you are at least 18 years old. The server stores that yes only when you send it. It does not assign an age, and it does not treat the declaration as verified identity or a verified date of birth. Do not register if you are under 18.

You may register with email and password, phone verification, Google, or Facebook, where that method is enabled. You must provide a name for email registration. You are responsible for the security of the email, phone, or provider account you use.

One person should keep one account. Account sharing, false identity, and impersonation are prohibited. The account belongs to the person who completed registration, subject to Winart’s right to suspend it under these terms. You may not sell the account.

Sign-in and security

Sessions are Firebase Authentication sessions. Sensitive deletion requires a sign-in that the server treats as recent. You must sign in again when the server asks. Password recovery for email accounts uses a reset email. Winart does not ask you to send your password to another user or to a support chat.

Device registry entries identify installations. Removing one does not remotely sign that device out.

Acceptable use

You are responsible for your profile, messages, voice, live video, comments, gifts, and payment references. You must follow the Rules and Regulations, Community Guidelines, Child Safety Policy, and the voice and live policy.

User content

You keep ownership of content you create, and you give Winart a non-exclusive licence to host, display, transmit, and moderate that content for the service, including to the users you choose to reach and to processors that deliver chat, storage, and realtime sessions. The licence ends when the content is deleted from the service, except for copies kept where the deletion policy says a record is retained, and except for content another user has lawfully received.

Winart may remove content or restrict an account when there is a report, a rule breach, or a legal requirement. Moderation actions that change report status are server-side and require an authorized admin. Ordinary users cannot edit someone else’s report.

Voice rooms, live streaming, and messages

Hosts and authorized moderators may use the room controls the server allows, including mute and removal where those actions are implemented. The client must not be treated as the source of a role. Tokens for realtime sessions are issued by the server. You must not share session credentials or attempt to join a room the server has closed.

Messages are visible to conversation members according to the product rules. Blocking limits further interaction as implemented. It does not erase history already delivered.

Gifts, Diamonds, and Creator Coin

Diamonds are used for eligible purchases and for sending gifts. Recharge is verified on the server. Winart does not credit Diamonds solely because the app shows a client-side success message. The customer recharge path in this release is manual INR review, including a transaction reference and an optional screenshot. This release does not offer a chain address, a chain deposit, or a chain withdrawal. Older server records may still exist from a disabled path. They are not a current payment method.

Google Play billing is not connected in this application. Diamonds and VIP are digital items. Selling them inside an app distributed on Google Play through a manual transfer is a policy question that this draft does not treat as approved.

Creator Coin is calculated only by the server economy. These terms do not state a conversion rate, a commission, a minimum withdrawal, a tax deduction, or guaranteed earnings. After an eligible withdrawal is completed, the server deducts the corresponding Creator Coin amount from the Creator Coin balance and writes a ledger entry. That deduction is part of the existing economy and is not changed by these terms.

VIP privileges are separate from payment-gateway logic. A payment message does not itself grant VIP.

Agency features use Winart’s agency records. An agency relationship does not transfer ownership of another user’s account. Agency fraud is prohibited. These terms do not invent an agency commission schedule.

Virtual items have no cash value except where a completed, eligible withdrawal is actually paid under the withdrawal process. Unpaid balances can be lost if an account is terminated for fraud or a serious rule breach, to the extent the ledger still allows a consistent record.

Payments, refunds, and fraud

You must submit payment references that match a real transfer you made. Duplicate submissions, reused payment references, and false screenshots are prohibited. Refund handling is described in the Refund and Cancellation Policy and does not override a completed server ledger entry except where that policy or the law requires a correction.

Intellectual property

The Winart name, logo, and application are owned by Winart Limited or its licensors. You may not copy the application or present yourself as Winart. Your content remains subject to the licence above. See the Intellectual Property Policy.

Suspension, termination, and deletion

Winart may warn, restrict, suspend, or terminate an account for a breach, using the severity approach in the Rules and Regulations. You may request deletion as described in the Account and Data Deletion Policy. Deletion does not remove every financial or conversation record. Winart does not claim that backups disappear at the moment the account is deleted.

Liability

The service is provided on an as-available basis. To the extent the law allows, Winart is not liable for lost virtual items, lost profits, or indirect loss, or for conduct of other users. Nothing in these terms limits liability that cannot legally be limited. Creator earnings are not guaranteed.

Disputes

Complaints start in the in-app grievance flow. These terms do not choose a court, an arbitration seat, or a governing-law clause beyond identifying Winart Limited, because the registered office and a legal contact are not on file. That choice requires legal review before publication.

Changes

Winart may update these terms by publishing a new version in the app. A material update requires a new acceptance. Previous acceptance records stay in the audit history.

User responsibilities

Give true registration information, keep your sign-in safe, follow the rules, and use payment and withdrawal features only for your own lawful transactions.

Winart responsibilities

Operate the features that are actually enabled, keep economy changes on the server, and describe limits honestly. Winart does not promise a staffed emergency team or a response time that has not been operationally verified.

Reporting and complaints

Use Report, Block, and the Legal Centre grievance form. Enforcement of reports is an admin function. You can see the status of your own report when the access rules allow that read. You cannot delete another person’s report or your own report after it is filed.
